The CLARITY Act, a legislative effort to establish a clear regulatory framework for digital assets in the United States, has failed to advance in Congress. The bill, which aimed to classify cryptocurrencies as securities or commodities and define oversight roles for the SEC and CFTC, stalled amid partisan disagreements and industry pushback. The failure leaves a legislative void that regulators are now filling through agency rulemaking.

Despite the bill's demise, federal agencies have continued to issue guidance and enforcement actions that effectively create a regulatory regime. The SEC has pursued cases against major crypto firms, while the CFTC has asserted jurisdiction over certain digital commodities. Industry observers note that these actions, while piecemeal, are shaping compliance expectations for advisors and investors. The lack of comprehensive legislation means financial advisors must navigate a complex web of state and federal regulations, increasing compliance costs and uncertainty. With Congress unlikely to revisit the issue soon, the crypto industry faces a future of regulatory ambiguity, prompting calls for clearer guidance from agencies and renewed bipartisan efforts.
