DMK MP P. Wilson Backs Simultaneous Polls Panel's Plan to Meet CJI, Sparks Separation of Powers Debate
DMK Rajya Sabha MP P. Wilson defended the simultaneous polls panel's plan to meet the Chief Justice of India, arguing that separation of powers does not mean the three organs of government operate in watertight compartments. The statement comes amid a debate over the constitutional propriety of the executive-appointed panel consulting the judiciary on the 'One Nation, One Election' proposal.
DMK Rajya Sabha MP P. Wilson on Tuesday defended the high-level committee on simultaneous elections' plan to meet the Chief Justice of India, stating that the separation of powers does not imply that the three organs of the state function in watertight compartments. His remarks came amid growing scrutiny over the panel's outreach to the judiciary.
Wilson, a senior advocate and DMK spokesperson, emphasized that the committee, chaired by former President Ram Nath Kovind, is merely seeking the views of the Chief Justice on the feasibility of holding simultaneous polls. He noted that the Constitution provides for consultation among organs and that such interactions are not unprecedented. The panel has already consulted various political parties and experts, but the decision to approach the CJI has raised questions about judicial independence and the propriety of the executive consulting the judiciary on a political matter.
The opposition parties, including the Congress, have criticized the move, arguing that it could compromise the judiciary's neutrality. Legal experts are divided, with some supporting the consultation as a routine exercise and others warning of potential overreach. The panel is expected to submit its report ahead of the 2024 general elections, and the outcome could significantly impact India's electoral landscape. The Chief Justice's response will be closely watched for its implications on the separation of powers doctrine.
